Proclamation Suspends the Entry of Certain H, L, and J Nonimmigrants

President Trump, citing the pandemic and the need to protect U.S. workers during the economic downturn, signed a Proclamation to extend the 60-day suspension of new immigrants to the U.S. ordered on April 22, 2020 and suspend and limit the entry of certain temporary worker visas through the end of 2020.

Effective Date: June 24, 2020. Expires December 31, 2020, and may be extended.

Who is affected by the Order?

The proclamation applies to any individual outside the U.S. on the effective date without a valid non-immigrant visa, who is seeking entry pursuant to the following nonimmigrant visas:  

  • H-1B visa or H-2B visa and anyone accompanying or following to join such individual
     
  • L visa and anyone accompanying or following to join such individual
     
  • J visa in the category of intern, trainee, teacher, camp counselor, au pair, or summer/work travel program and anyone accompanying or following to join such individual

Who is not affected?

  • Other J categories used in academic settings: professor, research scholar, short-term scholar, and college or university student
     
  • Students in F-1 status including those using Optional Practical Training (OPT) to work in the U.S. post-graduation from 12 months to up to 3 years for qualifying employment in STEM fields
     
  • Lawful permanent residents of the United States
     
  • Spouse or child of a U.S. citizen
     
  • Any alien seeking to enter the United States to provide temporary labor or services essential to the United States food supply chain
     
  • Any alien whose entry would be in the national interest as determined by the Secretary of State, the Secretary of Homeland Security, or their respective designees. This may include but is not limited to health care providers and medical researchers.
